AIRepScore™ Terms & Conditions

1. Introduction

These Terms & Conditions (“Terms”) govern the use of the AIRepScore™ platform, website, dashboards, reports and related services (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms.

2. Description of the Service

AIRepScore provides software and analytical services designed to measure, monitor and compare how artificial intelligence systems perceive, position and recommend brands, products, services and organisations.
The Service may include, but is not limited to:
• AI Credibility analysis
• AI Brand Perception analysis
• AI Positioning analysis
• AI Recommendation analysis
• Dashboard reporting
• Benchmarking functionality
• Historical tracking and trend analysis
• AI-generated insights and recommendations
AIRepScore is an analytical and informational platform only and does not provide legal, financial, investment or professional advice.

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements to use the Service.
If you use the Service on behalf of a company or organisation, you represent that you have the authority to bind that organisation to these Terms.

4. Accounts and Access

Users are responsible for:
• Maintaining the confidentiality of account credentials
• All activity occurring under their account
• Providing accurate registration information
• Promptly notifying AIRepScore of unauthorised access
AIRepScore may suspend or terminate access if misuse, fraud or security risks are detected.

5. Subscription and Fees

Certain features require a paid subscription.
Subscriptions may be offered on a:
• Monthly basis
• Annual basis
• Custom enterprise agreement
Fees are payable in advance unless otherwise agreed.
Failure to pay may result in suspension or termination of access.
All fees are exclusive of applicable taxes unless stated otherwise.

6. Intellectual Property

The AIRepScore platform, methodology, scoring framework, dashboards, reports, algorithms, designs, trademarks, graphics, documentation and software remain the exclusive property of AIRepScore and its licensors.
Nothing in these Terms transfers ownership of intellectual property to the customer.
The customer receives a limited, non-exclusive, non-transferable right to access and use the Service during the subscription period.

7. AIRepScore Methodology

The AIRepScore Framework is a proprietary methodology developed to evaluate AI perception and AI recommendation behaviour.
The methodology includes, among other elements:
• AI Credibility
• AI Brand Perception
• AI Positioning
• AI Recommendation
• Cross-model aggregation
• Model weighting
• Consistency scoring
• Confidence scoring
• Web Search Correction mechanisms
Customers may use the results generated by the platform but may not copy, reproduce, reverse engineer or commercialise the methodology without written permission.

8. Customer Content

Customers retain ownership of any content, brand names, URLs, company information or other materials submitted to the Service.
The customer grants AIRepScore a limited right to process such information solely for the purpose of delivering the Service.
Customers are responsible for ensuring they have the rights to provide submitted information.

9. Data Sources and AI Models

AIRepScore uses information generated by third-party AI systems and may incorporate information retrieved from publicly available online sources.
AIRepScore does not control the training data, outputs, availability or behaviour of third-party AI providers.
The Service may change when underlying AI models, search systems or external data sources change.

10. Accuracy

AIRepScore measures AI perception, not objective truth.
Scores, rankings, recommendations, insights and analyses reflect how AI systems interpret information at a specific point in time.
AIRepScore makes no guarantee that:
• AI outputs are accurate
• AI outputs are complete
• AI outputs are free from bias
• AI outputs reflect objective reality
• AI recommendations will remain stable over time
Users should not rely solely on AIRepScore results when making business decisions.

11. Benchmarking and Competitor Analysis

Customers may use the Service to analyse competitors and peer organisations.
AI Positioning supports up to a maximum of nine (9) peer competitors (plus the primary brand) in a competitive comparison set. Four (4) peers is the recommended default; configuring more than four peers increases monthly scan consumption and may reduce how often a full benchmark can be refreshed within the same plan limits.
AIRepScore does not verify or endorse any conclusions generated by AI systems regarding third parties.
Benchmarking results should be interpreted as AI-generated perceptions rather than factual statements about competitors.

12. Acceptable Use

Users may not:
• Use the Service unlawfully
• Attempt to reverse engineer the platform
• Copy or scrape platform content at scale
• Resell access without permission
• Interfere with platform operations
• Circumvent subscription limitations
• Use the Service to infringe third-party rights
Violation may result in suspension or termination.

13. Confidentiality

Both parties agree to keep confidential information confidential and not disclose such information to third parties except where required by law.

14. Limitation of Liability
To the maximum extent permitted by law, AIRepScore shall not be liable for:
• Indirect damages
• Consequential damages
• Loss of profits
• Loss of revenue
• Loss of data
• Loss of business opportunities
AIRepScore’s total liability shall not exceed the fees paid by the customer during the twelve (12) months preceding the claim.

15. Disclaimer

The Service is provided “as is” and “as available”.
AIRepScore expressly disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

16. Changes to the Service

AIRepScore may modify, improve or discontinue features at any time.
The platform may evolve as AI technologies, models and market conditions change.

17. Termination

Customers may cancel their subscription according to their subscription plan.
AIRepScore may terminate or suspend access for breach of these Terms.
Termination does not affect accrued payment obligations.

18. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of The Netherlands.
Any disputes shall be submitted to the competent courts in The Netherlands.
